Cherryvale Police Officers were called to a home at 135 W. Whelan St. in Cherryvale the evening of Monday, Nov. 26 for a report of a domestic disturbance with a shot fired. 

When officers arrived they found Richard L. Schultheiss, 62, of Cherryvale, unresponsive due to a single gunshot wound. He was transported to Independence Healthcare Center and ER where he was pronounced deceased.

During the initial investigation, officers placed Julie A. Minnich-Fagerstrom, 50, under arrest and processed her into the Montgomery County Jail in connection with the shooting. Minnich-Fagerstrom was booked into the jail under the charges of murder in the second degree, unintentional but reckless.

The investigation is ongoing and final charges will be determined by the Montgomery County District Attorney's office. Minnich-Fagerstrom will had her first court appearance Tuesday morning. Judge Jeffrey Gettler set a $50,000 cash or professional surety bond and a public defender attorney will represent her in court. She is to return to court Dec. 4 for a formal hearing and at that time the county attorney will name the detailed charges Minnich-Fagerstrom will face.
